Terms of service
Last updated 30 October 2026
Who you're working with
These terms are between you and 9th Degree Media, [REVIEW: registered company name and registration number, or "a sole proprietor based in [country]"].
By submitting a brief, paying an invoice or payment link, or using a client page, you agree to these terms. A signed proposal or statement of work for a specific project takes priority over these terms where they differ.
The founder's test
The Founder's Product Ad Test costs $300 (USD), paid upfront. It covers 2 ads for one product, delivered within 24 hours of receiving your product photos and payment, with 1 round of revisions.
In return, you agree to give us a short written review and permission to show the work in our portfolio. We'll only publish your name or brand with your permission.
If you start the monthly retainer within 30 days of delivery, the $300 is credited toward your first month.
The monthly retainer
Always-On Product Ads & Motion costs $2,000 (USD) a month, billed monthly in advance. It runs month to month, and either of us can end it with 30 days written notice. What's included each month is set out on our pricing section or in your proposal.
Unused deliverables don't roll over to the next month unless we agree otherwise in writing.
Custom projects
Commercials, brand films, campaigns and other custom work are quoted per project. Scope, price, timeline, deposit and number of revision rounds are set in the written proposal you approve.
Payment
All prices are in US dollars. Payments are made through [REVIEW: payment processor, currently Wise payment links]. Work starts once payment, or the agreed deposit, has cleared.
Any bank, currency conversion or transfer fees on your side are yours to cover.
Refunds and cancellations
[REVIEW: refund terms. For example: whether the $300 test is refundable before work starts, what happens if we miss the 24-hour delivery, and refunds on retainer months already paid.]
What we need from you
Clear product photos, accurate product information and any claims you can and can't make. You confirm that you own or have permission to use everything you send us, including photos, logos, music and footage, and that your product claims are true and lawful.
Deadlines depend on getting what we need from you. If photos or feedback arrive late, delivery moves by the same amount of time.
Revisions
Revisions are changes to the work we delivered, within the original brief. A new concept, a new product or a change of direction counts as new work and may be quoted separately.
Ownership and usage rights
Once you've paid in full, you can use the final delivered ads for your own brand in organic and paid placements, worldwide, with no time limit. Paid-usage rights are included.
We keep ownership of our working files, project files, templates and methods, and the right to show the work in our portfolio unless you ask us in writing not to.
Third-party assets such as licensed music, fonts or stock are covered by their own licenses. We'll tell you if a license limits how or where you can use a piece.
AI-assisted work
We use AI-assisted image and video tools alongside motion design and editing, always starting from your real product. Some ads may include AI-generated people. We label them on our own site, and we recommend you follow each ad platform's rules on disclosing AI-generated or altered content.
AI-generated material may have limited copyright protection in some countries, and similar results can be generated by others. We don't promise exclusive ownership of AI-generated elements.
Results
We work hard to make ads that perform, but we can't promise specific results such as sales, return on ad spend or approval by an ad platform.
Liability
To the extent the law allows, our total liability for any claim is limited to the amount you paid us for the work the claim relates to, and we're not liable for indirect losses such as lost profits. Nothing in these terms limits liability that can't be limited by law.
Confidentiality
We keep your unreleased products, briefs and business information confidential and only use them to do the work.
Governing law
[REVIEW: governing law and jurisdiction, for example the laws of South Africa and the courts of [city].]
Changes and contact
We may update these terms. The version in force when you place an order applies to that order. Questions: hello@9thdegreemedia.com.
